This breakout session will explore the development of case and trial narratives and themes through witness interviews and will include use of video interviews that illustrate how location, visual aids, and communication techniques draw out critical context for the subject incident and your client’s injuries/losses. Our discussion will specifically consider stereotypical notions of the value of non-economic damages in light of various factors.

As a participant, you will:

• Gain hands-on experience using technology to take video/sound recordings of your clients/witnesses;
• Practice interview techniques designed to draw out your client’s story and reveal the full scope and extent of their damages;
• Engage in framing exercises where you will be challenged to embrace “bad” as well as “good” facts in constructing the plaintiff’s story;
• Present the damages portion of a case you are presently working on and collaborate with the group to develop and solidify your case themes.
